Creativity can challenge an assumed structure and produce a more intentional result
Creativity can help us analyze everyday situations and complex relationships. We use creative thinking to imagine outcomes that advance our goals and intentions. In the boardroom, we share ideas that promote productivity. On site, we make quick decisions that diffuse disruption. During interpersonal encounters, we consider how best to approach uncomfortable realizations. In nearly every scenario, whether we recognize it or not, creative thinking influences our decisions.
For example, I considered how a romantic partnership relationship could be legally structured to accommodate a specific sort of parties’ individual needs. In some jurisdictions, two people with substantial assets and benefits might want to commit to sharing their lives without merging every legal and financial individual right. They might be concerned about healthcare, pension, inheritance, or retirement benefits.
A commitment to another person does not necessarily require combining all property and financial interests. A symbolic ceremony and a carefully drafted LLC agreement could allow the couple to choose what to share and establish how those assets would be managed or divided if the relationship ended. This approach creatively aligns their intentions with a desired result through an unconventional use of familiar legal structures.
The couple could remain legally unmarried while making a personal commitment through a symbolic ceremony. They could form an LLC to own and manage specifically identified shared assets. The operating agreement could define each person’s contributions and ownership interests and establish procedures for valuation, buyout, sale, distribution, dissolution, or succession if one person leaves or dies.
If the relationship ended, separation would not require a divorce or automatically trigger marital-property division. Instead, the LLC agreement would govern the shared assets it actually owned. Property held individually or jointly outside the LLC would require separate ownership, beneficiary, contractual, or estate-planning arrangements. Disputes could still arise, but they would generally concern business, contract, or property rights rather than divorce.
Each person would retain a separate legal identity and, if the LLC were taxed as a partnership, generally report his or her share of the LLC’s tax items on an individual return. Remaining unmarried might also preserve certain benefits or financial rights that marriage could affect, although healthcare, pension, retirement, inheritance, and survivor benefits would depend on the specific laws and plan terms involved.
Many jurisdictions make this example particularly relevant because common-law marriages can no longer be created there. A couple may therefore live together and make a meaningful personal commitment without becoming married solely through cohabitation.
The point is not that an LLC replaces marriage. It does not. Rather, creative thinking allows people to separate elements that convention often treats as inseparable. A couple could make a profound personal commitment while choosing which financial interests to combine and which to preserve individually.
For people with substantial assets or valuable individual benefits, this structure could provide commitment without automatically merging every legal and financial consequence associated with marriage. The ceremony would express the personal commitment, the LLC would govern designated shared property, and separate estate and financial planning would address everything else.
Any real arrangement would need to account for the couple’s assets, benefit plans, tax consequences, and estate plans with appropriate legal and tax advice. As a thought exercise, however, it illustrates the broader point: creativity often means viewing familiar structures differently and combining existing tools to produce a result that more precisely reflects our intentions.
Most importantly, for the purposes of this blog about creative approaches to everyday situations, this example is meant to illustrate that in everyday situations we can expand solutions that are suitable for a given situation using creative and knowledgeable approaches. As always, it is necessary to consult with qualified professionals before pursing or implementing anything.
